1. DEFINITIONS

CONTENT is defined as follows:
1. all SITE information that can be accessed, viewed, or otherwise accessed by using a numeric device;
2. the content of any newsletter or e-mail sent to USERS or CLIENTS by Allymet Technology Romania by electronic means and / or any other means of communication available;
3. any information communicated by any means by an employee of Allymet Technology Romania to the CUSTOMER or CLIENT, according to the contact information, whether specified or not;
4. information about the products, services and / or tariffs practiced by Allymet Technology Romania in a given period;
5. information on the products, services and / or tariffs practiced by a third party with whom Allymet Technology Romania has signed partnership contracts in a given period;
6. Data relating to Allymet Technology Romania, or other privileged data.
SERVICE - the e-commerce service conducted exclusively on the public parts available to the SITE in order to allow the CLIENT to contract products and / or services using exclusively electronic means, including other means of telecommunication.
USER - A natural or legal person, whether public or private, who has or obtains access to CONTENT by any means of communication (electronic, telephone, etc.) or under a usage agreement between Allymet Technology Romania and it without requiring an account.
CLIENT - The natural or legal person, whether public or private, who has or obtains access to CONTENT and SERVICE, by any means (electronic, telephone, etc.) or under a usage agreement between Allymet Technology Romania and him or her or legal entities that benefit from the products and / or services offered by Allymet Technology Romania and purchased by it through the use of the SERVICE

2. GENERAL POLICY
2.a. The document establishes the terms and conditions of use of the site / content / service by the user or the client, if it does not have another valid usage agreement concluded between Allymet Technology Romania and it.
2.b. Use, including but not limited to, accessing, visiting and viewing, content / service, implies the user or customer`s adherence to these terms and conditions unless the content has no distinct terms of use.
2.c. Access to the service is done exclusively by accessing the public website available www. https://www.profil-aluminiu.ro/.ro.
2.d. By using the site / content / service, the USER or the CLIENT is solely responsible for all activities that result from its use. He is also liable for any material, intellectual, electronic or any other kind of product, site, content, service, Allymet Technology Romania or any third party with which Allymet Technology Romania has entered into contracts in accordance with applicable Romanian law.
2.E If the UTILIZER or the CLIENT disagrees and / or does not accept and / or revokes its acceptance for the document:
2.f.1. It renounces: access to the service, other services offered by Allymet Technology Romania through the site, receipt of information and / or communications bulletins from Allymet Technology Romania of any nature (electronic, telephone, etc.), without any further guarantee from Allymet Technology Romania.
2.f.2. Allymet Technology Romania will delete all data that refer to it from its database without any subsequent obligation of either party to the other or without any party claiming the other damages.
2.f.3. It may return at any time to its decision not to agree and / or not accept the document in the form in which it will be available at that time.
2.g. THE CUSTOMER / USER may at any time return to his or her decision to agree and / or accept the document in the form in which it will be available at that time.
2.h. In order to exercise the right provided in art. 2.e, he may contact Allymet Technology Romania, or use the links in the content received from Allymet Technology Romania for this purpose.
2.i. The CLIENT can not revoke the agreement expressed in favor of the document during the duration of the CONTRACT, or until the moment it fails to pay the value of all unrelated CONTRACTS to Allymet Technology Romania.
2.j. In the event that the CLIENT has paid the value of all unrelated CONTRACTS to Allymet Technology Romania and revokes the agreement expressed in favor of the document, during the execution of a COMMITMENT, Allymet Technology Romania will cancel its ORDER without any further obligation of any party to the other without any party being able to claim the other damages.
4. CONTENT
4.a.This content, including but not limited to static images, dynamic images, text and / or multimedia content presented on the site are the intellectual property of Allymet Technology Romania or third parties, in which case the content may be followed by the title original property and / or any other notice required by the rightful owner of that content.
4.b. USER or CLIENT is not permitted to copy, transfer, modify and / or otherwise alter, use, link to, display, incorporate any content in any context other than the original intended by Allymet Technology Romania, including any content outside of Allymet Technology Romania, the removal of any sign that signifies the copyright of Allymet Technology Romania to content, as well as the participation in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the content, except with the express agreement of Allymet Technology Romania.
4.c. Any content to which the USER or the CLIENT has and / or obtains access by any means is under the Document, unless the content is accompanied by a specific and valid user agreement concluded between Allymet Technology Romania and the user, and without a default or express warranty on behalf of Allymet Technology Romania with reference to that content.
4.d. USER or CLIENT may only copy, transfer and / or use content for personal or non-commercial purposes only if they do not conflict with the provisions of the document.
4.E. If Allymet Technology Romania grants to the USER or CUSTOMER the right to use, as described in a separate use agreement, a certain content to which the USER has or will gain access under this agreement, this right extends only to that or of the same content as defined in the agreement, only during its existence or content on the Site or the period defined in the Agreement, under the terms defined in the Agreement, if any, and is not a contractual commitment from Allymet Technology Romania to that UTILIZER, CLIENT or any other third party who has / will gain access to this transferred content by any means and that could or may be harmed in any way from this content during or after the expiration of the use agreement.
4.f. No content transmitted to the UTILIZER or the CLIENT by any means of communication (electronic, telephone, etc.) or acquired by accessing, viewing and / or viewing constitutes a contractual obligation from Allymet Technology Romania and / or Allymet Technology employee Romania that mediated the transfer of content, if any, to that content.
4.g. Any use of the content for purposes other than those expressly permitted by the document or the accompanying User Agreement, if any, is prohibited.
5. CONTACT
5.a. Allymet Technology Romania publishes on the site the complete and correct identification and contact data of the CLIENT or USER
5.b. By using the contact form or the service present on the site, the UTILIZER or the CLIENT allows Allymet Technology Romania to contact him by any available means, including electronic means.
5.c Completing the complete or partial contact form and sending it is in no way a commitment from Allymet Technology Romania to contact the USER or the CLIENT.
5.d. Accessing the site, using the information presented within it, visiting the pages or sending emails or notices addressed to Allymet Technology Romania is done electronically, by phone or any other communication available to the USER or the CLIENT and Allymet Technology Romania , believing that he agrees to receive notifications from Allymet Technology Romania electronically and / or by telephone, including communications via email or announcements on the site.
5.e. Allymet Technology Romania reserves the right not to respond to all requests of any kind received through any means of communication (electronic, telephone, etc.).
6.b. Products and services
6.b.1. Allymet Technology Romania can publish on the site information about products, services and / or promotions practiced by it or by anybody
is another partner with whom Allymet Technology Romania has signed partnership contracts, within a certain period and within the available stock.
6.b.2. Products and / or services purchased through the service may be for the CLIENT`s personal use or may be intended for re-sale by third parties.
6.b.3. Allymet Technology Romania may limit the ability to purchase products or services available on the site at any one time to one or more CLIENTS.
7.b.4. Invoicing of purchased products is made exclusively in RON.
7.b.5. All information used to describe the products and / or services available on the site (static / dynamic / multimedia presentations / images) is not a contractual obligation on behalf of Allymet Technology Romania, as a presentation.
7.f. Contract and completion
7.f.1. Allymet Technology Romania will include in the package sent to the CLIENT all the necessary documents proving the purchase of the products / services by the CLIENT.
7.f.2. Allymet Technology Romania will facilitate the CLIENT`s information on the completion stage of the order or contract.
7.f.3. THE CONTRACT, together with the documents proving the delivery to the CLIENT of the products contracted by Allymet Technology Romania, becomes the NOTIFIED CONTRACT.
7.g. Transport
7.g.1. The customer can only opt for one of the transportation options of the purchased products / services available on the site at the time of the order, regardless of the type of his order.
7.h. Quality and warranties
· 7.h.1. Allymet Technology Romania`s quality and guarantee of Allymet Technology is totally revived by Allymet Technology Romania.
· 7.h.2. The quality and compliance of any other product or service provided by Allymet Technology Romania, but acquired as a result of contracting it from a third party, is entirely the same.
· 7.h.3. Allymet Technology Romania does not guarantee the stock availability of any product / service available for purchase on the site.
· 7.h.4 All products marketed by https://www.profil-aluminiu.ro, benefit from warranty conditions according to the legislation in force. The products sold are accompanied by warranty certificates.
7.i. Returning products
Under the current legislation, waiver is only applicable to individual customers.
7.i.1. The CLIENT may return the products purchased through a CONTRACT in the following situations:
· 7.i.1.1. The product does not comply with site specifications
· 7.i.1.2. Parcels with severe damage
· 7.i.1.3. Products that were delivered wrong
· 7.i.1.4. Products that have erroneously ordered features
· 7.i.1.5. The consumer has the right to terminate the contract unilaterally without penalty and without invoking a reason, within 14 calendar days of receipt of the product or, in case of service provision, from the conclusion of the contract. The only costs that can be borne by the consumer are the direct return of the products ", according to O.U.G. 34/2014.
7.i.2.CLIENT is obliged to notify Allymet Technology Romania of its intention to return the purchased products by any written communication (e-mail / fax / etc) within maximum 14 calendar days from receiving products and / or services, in the case of art. 7.i.1.5.
7.i.3. CLIENT is obliged to notify Allymet Technology Romania, its intention to replace the purchased products, according to art.7.i.1.4, by any means of communication (e-mail / telephone / etc) within maximum 14 calendar days from receipt of products and / or services in accordance with Article 7.i.1.5.
7.i.4.CLIENT that has notified Allymet Technology Romania in accordance with Article 7.i.2 / art. 7.i.3, is responsible for ensuring that the products to which it has referred will be returned to Allymet Technology Romania in maximum 14 calendar days from the date of dispatch of the notice, otherwise Allymet Technology Romania considers the claim unfounded.
7.i.5. CLIENT Allymet Technology Romania can not return the products acquired through a CONTRACT, and / or can not claim any other damages / damages for the following purposes or situations:
· 7.i.6.1. Replacing the product purchased with another product with other specifications or a different type, except as provided in art. 7.i.1.4.
· 7.i.6.2. Request for return in the case of art. 7.i.1.2 or 7.i.1.3 caused by any of the situations described in 7.i.1 has a dispatch date exceeding the 14 calendar days provided for in Article 7.i.1.5 of the working day following the date of the honored contract.
7.i.6. If the product is reimbursed, it will be made within 14 calendar days of confirmation
7.i.7. In case of replacing the product with an identical one, according to 7.i.1.4, the replacement shall be done under the conditions and limits of a normal order.
7.i.8. If the CLIENT has returned a product in accordance with the provisions of Article 7.i.1.4 and Allymet Technology Romania does not have an identical replacement product, it will provide the CLIENT with the value of the product and in accordance with 7.i.7.
7.i.10. The value of the additional services, including but not limited to the transportation of the products, paid by the CLIENT, shall not be reimbursed.
7.i.11. In all cases, the return / re-shipping costs will be borne by the CLIENT.

7.i.13 Products not subjected to unauthorized interference, wear or excessive scratches, scratches, blows, mechanical / electrical shocks, products lacking accessory shall not be accepted.
7.i.14 The products that the CLIENT returns must be in the same state he has received.
7.i.15 The return shall be made in the original package, with the original intact labels, the original warranty certificate and all the documents with which the product was delivered. If the CLIENT has bought several products of the same kind and wants to return them all, he must ensure that only one has been unsealed. The return of other products is only accepted if they are sealed.
